General Standing Statute

Under the general standing statute, a grandparent or grandparents who have had possession of and primarily raised their grandchildren for at least six months ending not more than 90 days preceding the date of filing the petition may file a suit seeking custody.

Significant Impairment Statute

If the general standing statute does not apply to you, you may file a suit for conservatorship under the significant impairment statute. Here, you must prove that the children's parents are unfit to raise them and that their present circumstances can adversely affect their children's physical health or emotional development.

Possession and Access Statute

If you are seeking to file a suit for the purpose of access or possession, you must prove that denial of access to or possession of the child would significantly impair the child's physical and emotional well-being.
