Grandparents' Rights

At Brian Andrade Family Law, we understand the importance of grandparents' rights and the significant role they play in their grandchildren's lives. While the laws governing grandparents' rights in Texas are restrictive, our experienced attorneys can help you navigate the legal system and pursue access to or custody of your grandchildren.

What are Grandparents' Visitation Rights Dependent On?

Grandparents do not have automatic visitation rights, but visitation may be granted in certain circumstances, such as:

  • When the grandchild's parent is deceased
  • When a parent is incarcerated
  • When the grandchildren are in immediate danger due to abuse, alcohol, or drugs

Our grandparents' rights attorneys can investigate these issues and help you determine the most appropriate course of legal action.

When Can Grandparents Get Court-Ordered Custody of Their Grandchildren?

If you are seeking custody of your grandchildren, you must establish standing and prove that the relief you seek is in the children's best interest. Our attorneys can help you navigate the legal process and file a petition for custody under the Texas Family Code.

General Standing Statute

Under the general standing statute, a grandparent or grandparents who have had possession of and primarily raised their grandchildren for at least six months ending not more than 90 days preceding the date of filing the petition may file a suit seeking custody.

Significant Impairment Statute

If the general standing statute does not apply to you, you may file a suit for conservatorship under the significant impairment statute. Here, you must prove that the children's parents are unfit to raise them and that their present circumstances can adversely affect their children's physical health or emotional development.

Possession and Access Statute

If you are seeking to file a suit for the purpose of access or possession, you must prove that denial of access to or possession of the child would significantly impair the child's physical and emotional well-being.
